Proposition 65 Warning – California Residents
Proposition 65 is a unique California law requiring businesses to warn consumers about potential exposure to any of over 900 chemicals identified by the State of California as causing cancer, birth defects, or other reproductive harm — including lead and acrylamide. The thresholds set under Prop 65 are often significantly lower than federal or international standards — in the case of lead, up to 1,000 times lower than the EPA’s “No Significant Risk Levels.”
Due to the presence of lead in soil, plants of all types — including cassava and plantains — may naturally absorb trace amounts of heavy metals through no act of adulteration. In addition, acrylamide can form naturally in certain foods during high-temperature cooking processes such as frying or baking, and is not intentionally added to foods.
While the original intent of Prop 65 was to promote transparency and consumer safety, the law’s broad and often ambiguous language has also led to widespread litigation. Many food companies — even when confident their products pose no meaningful risk — choose to settle to avoid costly legal battles. In 2015 alone, Prop 65 settlements exceeded $26 million.
In accordance with the law, and out of an abundance of caution, we are providing the following warning:
